Thetafan Studio (Beta) User Agreement

Effective Date: 1st February 2026

This Thetafan Studio (Beta) User Agreement (“Agreement”) is entered into between FandomIQ, Inc., operator of the Thetafan platform (“Company,” “we,” “our,” or “us”), and the individual user (“you”).

This Agreement governs your access to and use of Thetafan Studio (Beta).

By accessing or using Thetafan Studio (Beta), you agree to this Agreement.

1. Beta Program Overview

Thetafan Studio (Beta) is a limited-release, experimental version of our production intelligence platform powered by Thetafan’s metrics.

Features, performance, pricing, and availability may change at any time.

Participation in the beta does not guarantee:

  • Continued access

  • Future feature availability

  • Conversion to a paid subscription

  • Preferential pricing in future releases

2. Eligibility

You must:

  • Be at least 18 years old

  • Have authority to enter into this Agreement

  • Provide accurate and complete registration information

We may deny or revoke access at our discretion.

3. Fees and Payment

If applicable:

  • A one-time beta access fee may apply

  • All payments are processed securely through third-party processors (e.g., Stripe)

  • We do not store full payment card details

  • All payments are in USD

  • Beta fees are non-refundable

Payment for beta access does not grant rights to future versions of Thetafan Studio or Thetafan metrics.

4. Limited License

We grant you a limited, non-exclusive, non-transferable, revocable right to access and use Thetafan Studio (Beta) for lawful purposes.

All underlying software, AI systems, algorithms, models, and intellectual property remain the exclusive property of FandomIQ, Inc.

No ownership rights are transferred.

4.b Order Confirmation

Your beta access or purchase is considered complete once we send a confirmation email, access credentials, or digital receipt.

5. Acceptable Use & Code of Conduct

You agree not to use Thetafan Studio to:

  • Violate applicable laws or regulations

  • Infringe intellectual property or privacy rights

  • Generate or distribute unlawful, harmful, or exploitative content

  • Promote violence, exploitation, or illegal activity

  • Harass, threaten, or target protected groups

  • Distribute malware, spam, or disruptive code

  • Doxx or expose private information without consent

We may interpret and enforce these rules using reasonable judgment based on user safety, legal compliance, and platform integrity.

We may remove content or suspend access if violations occur.

6. Your Content & Responsibility

You are solely responsible for:

  • Content you upload

  • Prompts you submit

  • Outputs you distribute or rely upon

  • Ensuring you have the rights to use submitted material

Thetafan does not provide copyright clearance or legal review.

If we receive credible complaints regarding your content, we may investigate, remove content, or suspend access.

7. AI-Generated Outputs

Thetafan Studio generates outputs using automated AI systems.

You acknowledge:

  • Outputs are probabilistic and may be inaccurate

  • Outputs may reflect bias, incomplete information, or unexpected results

  • AI outputs are not legal, financial, medical, or professional advice

You agree to independently review and verify outputs before relying on them.

You assume responsibility for how outputs are used.

8. Use of Data to Improve the Service

You authorize FandomIQ to use:

  • Interaction data

  • Usage metadata

  • System performance data

for the purpose of operating, improving, and evaluating Thetafan systems.

We may use aggregated or de-identified data to enhance models and platform functionality.

All improvements and resulting intellectual property remain owned by FandomIQ.

9. Confidentiality

Because Thetafan Studio may operate in strategic or sensitive environments:

  • Do not upload confidential or highly sensitive data during beta

  • Do not share non-public platform materials without authorization

Separate NDAs may apply where executed.

10. Data Storage and Backup

We do not guarantee storage, backup, or retrieval of:

  • Uploaded content

  • Generated outputs

  • Historical session data

You are responsible for saving materials you wish to retain.

11. Third-Party Dependencies

Thetafan Studio relies on third-party infrastructure, including:

  • Cloud hosting providers

  • AI model providers

  • Payment processors

Service interruptions, latency, or outages may occur.

We are not liable for failures or degraded performance caused by third-party services.

Your information is handled in accordance with our Privacy Policy.

Do not upload sensitive or confidential information while the service is in beta.

12. High-Risk Use Restrictions

Thetafan Studio may not be used in high-risk environments where system errors could result in:

  • Personal injury

  • Medical decisions

  • Emergency response failures

  • Aviation or nuclear operations

The beta is not designed for mission-critical or life-dependent applications.

13. Security

We implement reasonable technical and organizational safeguards.

However, no system is completely secure, and you use the beta at your own risk.

14. Suspension or Termination

We may suspend or terminate access if:

  • You violate this Agreement

  • We receive credible complaints

  • Required by law

  • Necessary to protect users or the platform

No refunds are issued upon suspension.

You may discontinue use at any time.

15. Feedback

If you provide feedback or suggestions, you grant FandomIQ the unrestricted right to use them without compensation.

16. Disclaimer of Warranties

Thetafan Studio (Beta) is provided “as is” and “as available.”

We disclaim all implied warranties to the fullest extent permitted by law.

17. Limitation of Liability

To the maximum extent permitted under California law:

FandomIQ is not liable for indirect, incidental, or consequential damages, including lost profits, lost data, or business interruption.

Your use of the beta is at your own risk.

18. Indemnification

You agree to indemnify and hold harmless FandomIQ from claims arising from:

  • Your content

  • Your misuse of the service

  • Your violation of this Agreement

19. Export Compliance

You agree to comply with applicable U.S. export and sanctions laws.

You may not use Thetafan Studio if you are in a restricted jurisdiction or on a prohibited government list.

20. Dispute Resolution

Disputes shall be resolved in the courts located in San Diego, California.

You waive:

  • Jury trial rights

  • Participation in class actions

to the extent permitted by law.

21. Changes to This Agreement

We may update this Agreement at any time.

Continued use of Thetafan Studio constitutes acceptance of any updates.
